Court proceedings between Australian fashion designer Kymberley Ellery and Myer has begun in the Supreme Court of Victoria

This comes after Ellery supposedly breached an exclusive contract with the department store giant when the designer signed a contract to supply its autumn/winter Ellery label collection to rival David Jones. This new partnership was shown off in DJs’ autumn/winter 2013 launch in February when model Miranda Kerr opened the show in an Ellery dress.

Myer is seeking an injunction to restrain Ellery from supplying David Jones. However, the Ellery label released a statement that said: "Ellery contends that the exclusivity agreement is in restraint of trade and unreasonable, and therefore unenforceable.".

When RetailBiz spoke to Myer in January about the legal actions, a Myer spokesperson said legal proceedings were necessary after the issue could not be resolved.
