Following the federal court’s approval Metcash’s acquisition of the Franklins supermarket chain, the Australian Competition and Consumer Commission (ACCC) will consider the judgement.

This comes in the wake of the federal court dismissing the ACCC’s application to prevent Metcash from acquiring the Franklins business.

“The ACCC will closely examine the judgment before commenting further,” ACCC chairman Rod Sims said.

The ACCC filed an appeal on Friday 9 September 2011 against the federal court’s judgment dismissing the ACCC’s application to prevent Metcash from acquiring the Franklins supermarket business.

The appeal was heard in Sydney in late October and judgment was handed down on Wednesday 30 November.
